Acceptable Use Policy

This Acceptable Use Policy ("Policy") governs your use of services provided by Brands Group LLC. This Policy is designed to protect our clients, our business, our service providers, and the broader internet community from irresponsible or illegal activities.

By engaging our services, you agree to comply with this Policy.

You may not use our services for any purpose that is unlawful, harmful, or violates this Policy. Specifically, you agree NOT to:

  • Infringe on the intellectual property rights of others, including copyrights, trademarks, patents, or trade secrets
  • Use copyrighted materials, images, logos, or content without proper authorization or licensing
  • Create knockoff, counterfeit, or misleadingly similar brands or products
  • Violate the Digital Millennium Copyright Act (DMCA) or similar laws

5. Deceptive or Fraudulent Practices

  • Create or promote deceptive, misleading, or fraudulent content or business practices
  • Engage in phishing, scams, or other fraudulent schemes
  • Make false or misleading claims about products, services, or business practices
  • Impersonate another person, business, or entity
  • Create "get rich quick" schemes, pyramid schemes, or multi-level marketing programs that violate FTC guidelines

6. Spam and Unsolicited Communications

  • Send unsolicited bulk emails (spam) or facilitate spamming activities
  • Violate the CAN-SPAM Act or similar anti-spam laws
  • Harvest email addresses or contact information without consent
  • Use purchased or scraped email lists without proper opt-in consent
  • Send deceptive or misleading email headers or subject lines

7. Malicious Activities

  • Distribute malware, viruses, trojans, ransomware, or other harmful software
  • Engage in hacking, phishing, or unauthorized access to computer systems
  • Launch denial-of-service (DoS) attacks or other network attacks
  • Exploit security vulnerabilities for malicious purposes
  • Engage in cryptojacking or unauthorized use of computing resources

8. Harmful or Offensive Content

  • Promote, distribute, or facilitate access to adult or sexually explicit content (pornography, escort services, adult entertainment)
  • Promote or incite violence, terrorism, or harm to individuals or groups
  • Promote hate speech, discrimination, or harassment based on race, religion, gender, sexual orientation, disability, or other protected characteristics
  • Exploit, harm, or endanger minors
  • Promote self-harm, suicide, or eating disorders
  • Create or distribute content that is defamatory, libelous, or invasive of privacy

9. Payment Processor Violations

  • Engage in activities that violate payment processor policies (e.g., Stripe, PayPal)
  • Process payments for prohibited businesses or high-risk activities without proper approval
  • Engage in chargebacks fraud or abuse payment systems
  • Process payments for businesses in prohibited categories (gambling, adult content, illegal drugs, weapons, etc.) unless explicitly allowed by your payment processor

10. Restricted Industries and Businesses

While we work with businesses across many industries, we reserve the right to refuse service to businesses in the following categories:

  • Adult entertainment or sexually explicit content
  • Illegal drugs, drug paraphernalia, or unregulated pharmaceutical sales
  • Weapons, explosives, or ammunition (without proper licensing)
  • Gambling or online casinos (unless properly licensed)
  • Cryptocurrency schemes, unregistered securities, or "get rich quick" programs
  • Multi-level marketing or pyramid schemes that violate FTC regulations
  • Payday loans or predatory lending practices
  • Hate groups or organizations promoting violence or discrimination
  • Counterfeit goods or intellectual property infringement

11. Privacy and Data Protection Violations

  • Collect, use, or share personal data in violation of privacy laws (GDPR, CCPA, etc.)
  • Engage in unauthorized surveillance or data collection
  • Sell or share personal information without proper consent
  • Violate data breach notification requirements

12. Misuse of Our Services

  • Attempt to reverse-engineer, decompile, or extract proprietary methods from our work
  • Resell or redistribute our services without authorization
  • Use our services to compete directly with us
  • Provide false or misleading information during the quote or onboarding process
  • Use our deliverables in ways inconsistent with the agreed scope or license

13. Consequences of Violation

If we determine (in our sole discretion) that you have violated this Acceptable Use Policy, we may:

  • Issue a warning and request immediate remediation
  • Suspend services until the violation is resolved
  • Terminate the service agreement immediately
  • Refuse to provide future services
  • Withhold deliverables until the violation is addressed
  • Report illegal activity to appropriate law enforcement authorities
  • Take legal action for damages or breach of contract

Refunds for terminated services due to policy violations will be handled according to our Refund & Cancellation Policy, with consideration for work completed and the nature of the violation.

14. Our Right to Refuse Service

We reserve the right to refuse service to any individual or business, at any time, for any reason consistent with applicable law. This includes:

  • Businesses or projects that violate this Policy
  • Businesses in industries we choose not to serve
  • Projects that pose legal, ethical, or reputational risks
  • Clients who are abusive, threatening, or disrespectful to our team

15. Reporting Violations

If you become aware of any violation of this Acceptable Use Policy by another user or client, please report it to us:

16. Client Responsibilities

You are responsible for:

  • Ensuring all content, materials, and information you provide comply with this Policy
  • Obtaining necessary licenses, permissions, and rights for all materials you provide
  • Using our deliverables in compliance with this Policy and applicable laws
  • Indemnifying us against claims arising from your violation of this Policy

17. Changes to This Policy

We may update this Acceptable Use Policy from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the updated Policy.
